Shopping regulations

Regulations of the online store www.sklep-eyfelperfumy.pl effective from August 5, 2018

STATUTE

GENERAL INFORMATION

The Regulations of the Online Store, hereinafter referred to as the "Regulations", define the rules for using the Online Store, placing an order for Goods available in the Online Store, delivering the ordered goods to the Buyer, paying the sales price for the goods by the Buyer, the Buyer's right to withdraw from the contract and the rules for submitting and considering complaints.
The Seller ensures that the Buyer using the Online Store will operate correctly in the following browsers: Explorer version 11 or newer, Firefox version 28.0 or newer or Chrome version 32 or newer, on screens with a horizontal resolution above 1024 px. The use of third-party software that affects the operation and functionality of browsers: Internet Explorer, FireFox, Opera, Chrome, Safari may affect the correct display of the store, therefore, in order to obtain full functionality of the store, they should all be disabled.

All prices quoted by the Seller are expressed in Polish currency and are gross prices (including VAT). Product prices do not include delivery costs.

The Seller reserves the right to change the prices of products offered by the Online Store, introduce new products to the Store's offer, conduct and cancel promotional campaigns on the Store's website or make changes to them, in accordance with these Regulations or the regulations of a given promotion. The changes introduced may not affect the effectiveness and manner of executing previously placed orders.
The Buyer is obliged to comply with these Regulations.

DEFINITIONS

The following meanings have been assigned to the following expressions used in the text of the Regulations:

Customer – an adult natural person with full legal capacity, a legal person or an organizational unit without legal personality but with legal capacity, making a purchase from the Seller directly related to its business or professional activity.
Consumer – an adult natural person with full legal capacity, making a purchase from the Seller that is not directly related to his or her business or professional activity.
Basket – a list of Products prepared from the Products offered in the Store based on the Buyer's choices.
Buyer – both Consumer and Customer.
Place of delivery of the item - postal address indicated in the Order by the Buyer;
The moment of delivery of the item - the moment when the Buyer or a third party indicated by him to collect the item takes possession of the item.
Payment – the method of payment by the Buyer for the subject matter of the contract and delivery listed here.
Product – goods offered for sale by the Seller in the Store. Product photos are for illustration purposes only. The colors of the Products may differ slightly from those in reality - they depend, for example, on the monitor settings (color saturation and other settings).
Subject of the contract – Products ordered by the Buyer along with the delivery service.
Store – online service available at www.sklep-eyfelperfumy.pl through which the Buyer can place an order.

Orders

You can purchase the product by registering on the online store's website and providing the data necessary to complete the order.

The Customer selects the Goods ordered by adding them to the cart.

After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed.

The buyer is obliged to provide correct and complete personal data, otherwise the order may not be completed due to the impossibility of delivering the goods.

Orders can be placed via the Store's website.

Forms completed incorrectly do not constitute an order and will not be processed. In particular, forms that do not contain the Customer's contact telephone number or e-mail address enabling the Store to confirm the received order will be considered incorrectly completed forms. The Store does not inform the Customer about the rejection of the order form if the Customer has not provided contact details enabling contact by phone or e-mail.

If there are any doubts regarding the content of the order form submitted by the Customer and received by the Store, the Store reserves the right to suspend the execution of the order until such doubts are clarified. The Store will immediately notify the Customer about the suspension of the order.

Placing an order involves the obligation to pay for the selected goods, and the entrepreneur undertakes to deliver the goods without defects.

Orders can be placed 24 hours a day, 7 days a week.

Payment methods

Payment for the products purchased in the Store, according to the Customer's choice made on the order form, takes place:

Delivery

The ordered items will be delivered to the Customer according to his/her choice via a courier company. InPost SA The Customer may collect the ordered goods at the store's premises or at a parcel locker. The data on the shipment will include the name and surname and address provided by the Customer in the order form. Together with the shipment, the Customer will receive written confirmation of the essential elements of the concluded sales contract along with the regulations and annexes.

The customer has the right to choose - within the limits specified in the content of the order form - the method and company of delivery. When making a choice, you also agree to the prices related to the selected method and entity performing the delivery, which in this case may vary.

The order processing time is up to 14 days from the date of final confirmation of the order by the Customer and is the time during which the Store staff will prepare the ordered items and hand over the parcel to the courier company for delivery to the Customer. The store is not liable for delays or non-delivery of the shipment resulting from providing incorrect address details of the Customer or other reasons attributable to the Customer.

The Store is not responsible for technical problems or technical limitations occurring in the computer equipment, end device, IT system and telecommunications infrastructure used by the Customer, which prevent the Customer from using the Store correctly.

Shipping costs are borne by the customer and depend, among others, on: on the weight of the shipment, its value, etc.

Return of order – right to withdraw from the contract

The customer has the right to withdraw from a distance sales contract without giving a reason, within 14 days from the date of receipt of the goods.

If you exercise the right to withdraw from the concluded contract, you must submit a written declaration of withdrawal from the contract and send a signed declaration. Postal address: Al. Jerozolimskie 54/38, 00-024 Warszawa, before the above-mentioned deadline.

The declaration of withdrawal from the contract, the bank account number to which the money should be returned to the customer and the returned goods should be sent to the following address:

The money will be returned to the customer to the bank account indicated by him, the number of which should be attached to the sent declaration of withdrawal from the contract.

The returned goods must be sent back immediately, but no later than within 14 days from the date of sending the seller the declaration of withdrawal from the contract.

The customer is asked to return the goods in the original packaging with all its contents and a copy of the proof of purchase.

The returned goods must be in unchanged condition, i.e. they must have the original labels and cannot bear any traces of use beyond the scope of normal inspection.

Withdrawal from the contract

A customer who is not an entrepreneur has the right to withdraw from the contract concluded via the Store within fourteen days from the date of delivery of the item. The condition for exercising the right to withdraw from the contract is for the Customer to submit an appropriate declaration in writing.

Goods delivered to the customer via InPost SA or a courier company should be sent to the following address: Al. Jerozolimskie 54/38, 00-024 Warszawa.

Return

If the Customer receives an order in damaged packaging, first report this fact to a Store employee via e-mail and then return the goods to the Store.

The refund payment will be sent to the bank account provided in the refund form or sent by postal order.

Final Provisions

By checking a special check-box, the Customer consents to the use and processing of his or her personal data for the purpose of executing the order, as well as the transfer of his or her e-mail address to external companies and to the processing of personal data by the Seller and external companies in order to complete a survey to evaluate the ordering process, a survey evaluation of order execution and product evaluation surveys (in accordance with the provisions of the Personal Data Protection Act of August 29, 1997).

For the avoidance of doubt, it is stated that none of the provisions of these Regulations limit the Consumer's rights under the provisions of law in force in the territory of the Republic of Poland. If the existence of such a provision is found, the provisions of the law in force in the territory of the Republic of Poland shall apply, in particular the Civil Code and the Act of May 30, 2014 on consumer rights.
